Any dispute shall first be resolved through good faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Palm Beach County, Florida, under the Commercial Arbitration Rules of the American Arbitration Association. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
Class Action Waiver: All disputes must be resolved individually. No class, collective, or representative actions are permitted. You waive the right to trial by jury. If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in effect, except that if the class action waiver is found unenforceable, the entire arbitration provision shall be null and void.
These Terms are governed by the laws of the State of Florida without regard to conflict of law provisions. If arbitration does not apply, exclusive jurisdiction lies in state or federal courts located in Palm Beach County, Florida.
Any claim arising from use of this Site must be brought within one (1) year after the cause of action accrues. Claims not brought within this period are permanently barred.
